Movilest Co., Ltd. (Hereinafter "Movilest") makes available to you the present general terms and conditions of use (hereinafter the "Terms and Conditions") which will apply to the use of the application COCOIN (the "Application"), www.movilest.com (the "Site"), as well as all content, products, services and functions available on or through the Application and / or the Site (together with the Application and the Site, the " Services").
By clicking or checking the box "Terms and Conditions", you accept and agree to be bound by these Terms and Conditions, acquiring the status of user (the "User"). Likewise, by the mere fact of downloading, installing, accessing or otherwise making use of the Services, implies that the User understands and accepts fully and unconditionally, each and every one of the general and particular conditions included in these Terms and Conditions.

General disposition
The Services may be used only for lawful purposes. The content, information and / or material that Movilest makes available to the User through the Application and / or the Site contain elements protected by intellectual property rules, including protection of software, trademarks, photographs, logos, designs, graphic images, Music and sound, without this description implying limitation of any nature.
The parents or guardians of minors shall be responsible for the acts performed by them pursuant to the provisions of these Terms and Conditions, including damages caused to third parties, actions performed by them and prohibited by law and by the provisions of this agreement, Without prejudice to the responsibility of the User, provided that the latter is not the parent or legal representative of the minor offender.
Services
Through the Application and the Site, Movilest offers to its Users and clients the Services, which consist, among other things, to make available to its Users advertisements of their own or of third parties related to all types of products, services, offers and Other advertising content permitted by law and which may be of interest to them (collectively the "Contents") through the blocking screen of the Users' mobile equipment (such as mobile phones or smartphones, electronic tablets and other devices compatible with the Application) that have downloaded and installed the Application (the "Mobile Equipment") or that enter the Site.
Likewise, through the use of the Services, Users may (but not necessarily do) obtain various benefits such as exclusive offers or obtaining virtual points called "COCOIN Currencies" (indifferently "COCOIN Coins" Or just "Coins").
The User acknowledges and expressly agrees that Movilest may obtain remuneration from third parties who wish to provide the Contents and that any benefit granted to the User by the Services will not (but may) be proportional to the benefits that Movilest obtains from said third parties.
COCOIN Currencies (Coins)
The User, through the use of the Services and as available to Movilest, may obtain COCOIN Currencies (Coins), which may be exchanged for various products or services such as Mobile network operators, convenient stores indicated in the Application or in the Site, discount coupons or any other promotion available to Movilest from time to time.
The COCOIN Currencies (Coins) are non-transferable and may only be used for the purchase of products or services marked with such promotion within the Application or on the Site.
The COCOIN Currencies (Coins) will have validity, same that will be appreciated in the relation of COCOIN Currencies (Coins) that appear in the account of each User, this validity cannot be extended for any reason.
The COCOIN Currencies (Coins) are for the exclusive use within the Application or the Site, reason why under no circumstances they can be interchangeable for money in cash or any other product that is not marked with this promotion.
The COCOIN Currencies (Coins) are valid for one year from the date of earning, and expired coins are removed at the end of each month. The coins about to expire can be found in the menu, Coin History, in the application.

Similarly, Movilest does not guarantee that the User will obtain a fixed amount of COCOIN Currencies (Coins) for the use of the Services, nor that the products or promotions by which they can be exchanged will always be available.
Contents
The Content displayed on the Application or on the Site may be owned by Movilest or third parties, and may include all types of files such as texts, images, sounds and videos, as well as links to other sites or applications outside of Movilest.
Access to any Content including the links displayed in the Application or on the Site is optional, and will be at the sole risk and responsibility of the User, who acknowledges that he has at all times absolute discretion to activate or not such links.
For the foregoing and whenever Movilest has no control over such Content, including the sites or applications to which the links are linked, Movilest shall not be liable for the contents, materials, actions and / or services provided by them, nor for damages or Losses caused by the use thereof, are caused directly or indirectly. The presence of links to other websites does not imply a partnership, relationship, approval, sponsorship or endorsement of Movilest to such sites and their contents.

Failure to comply with the above shall subject the offender to all civil claims and penal sanctions that may correspond under applicable law.
User Registration
In order to access the Services, the User must register by creating an account in the Application or on the Site, for which he must either (i) provide Movilest with the information necessary to register, or (ii) Access through an account that the User has in any social network or application of those admitted by the Application and the Site (e.g. through the User's Facebook account); And create a personal password (password). Notwithstanding the foregoing, the use of the Services is based on good faith between the parties, whereby Movilest shall not be bound (but shall retain the right, which may be exercised at any time) to verify the authenticity of the information provided by the User.
Through your account, the User may, among other things, access and modify or update his information at any time, as well as review the history of COCOIN Accumulated and exchanged coins, and generally access the Services and Contents of his interest.
The User is responsible for protecting the confidentiality of the password of his account in the Application and on the Site. The User agrees to inform Movilest of the loss, or theft of his personal password, immediately after being aware of the fact. Until Movilest is effectively informed of the loss, or theft of the personal password, the User will be solely liable for damages resulting from its eventual use by third parties, and Movilest has no liability for any damages Product of such facts.
The account is personal and non-transferable, and in no way will COCOIN Currencies (Coins) or any other benefit between different accounts be accumulated or exchanged.

Access and Use of Services

Therefore, Movilest is not responsible for any damage, loss or loss to the User caused by failures in the system, the server or the Internet. Movilest reserves the right to discontinue the dissemination of any information, alter or delete transmission methods, alter the data transmission rate or any other signal characteristics.
Intellectual property
The software associated with the Application, the Site, as well as all Content available therein, including the links, are, for the purposes of this document, Movilest-exclusive property and are protected by international copyright laws and treaties Trademarks, patents, models and industrial designs applicable in Mexico.

Movilest reserves all rights not expressly granted herein. The User declares and acknowledges that the download of any content of the Application or the Site does not confer ownership on it.
Any trademarks displayed on the Application, the Site or any link shall not be deemed to be in the public domain and are the exclusive property of the third party contractors of Movilest.
Movilest does not have the duty or the responsibility to provide to the User any indications that assist the identification of the content as protected by intellectual property rights. The User shall be solely responsible for any damages to third parties that result from the infringement of intellectual property rights, by virtue of the unauthorized use of said Content.
License
Through this document and subject to compliance with these Terms and Conditions, Movilest grants to the User a limited, non-exclusive, non-transferable, non-sublicensable, revocable, for an indefinite period of time, to (i) download, install and Use the Application on a Mobile Device, or to access the Services through the Site, and (ii) to use the Services; In both cases such license shall be for the User's personal use and in no event may be sublicensed, resold or otherwise exploited without Movilest's prior written consent.
Any unauthorized use of the Services or in contravention of these Terms and Conditions will result in immediate termination and no need for judicial resolution of the license granted in favor of the User pursuant to the previous paragraph.
Updates
Movilest may, at any time, not be required to make any modifications, additions or improvements to the Services, including without limitation, the Contents as well as the functions and versions of the Application and Site software in general (the " Updates "). Such Updates are intended to improve the Services for the benefit of the User, as well as to display updated and updated Contents with the interests of Users at all times, or, if necessary, to repair any failure that could present the Application or the Site.

The User understands that some Updates may be indispensable for the continuity of the provision of the Services in their favor, so in case the User refrain from downloading and installing an Update, the Application or the Site may cease to function in Your Mobile Device. Movilest will not be responsible for any damage or loss that may be caused to the User as a result of the omission in downloading and installing any Update.
The present Terms and Conditions will be applicable for any Updating of the Services, unless stipulated to the contrary, reason why in case of downloading the User install any Update will be understood that it accepts the same.
Privacy
Movilest will implement all possible measures to maintain the confidentiality and security of the User's information, but will not be liable for damages that may arise from the violation of those measures by third parties using public networks or the Internet, altering Security systems to gain access to User information.
Notwithstanding the foregoing, the use of the Services is conditioned to the reading and acceptance by the User of the Notice of Privacy, which is available to you both in the Application and on the Site.
Continuity of Services
The User acknowledges that there may be (i) interruptions in the provision of Services or Updates, or even (ii) other events occurring due to causes beyond Movilest's control. Movilest shall not be liable for any data lost during the transmission of information over the Internet.

Movilest shall not be liable for any errors or omissions contained in the Services.

Limits of Liability and Guarantees
To the maximum extent permissible under applicable law, Movilest, its suppliers, contracting third parties and other partners, are exempt from all warranties and conditions, express or implied, including implied warranties and conditions of merchantability appropriate for a particular purpose and not in violation of property rights.
The User understands and agrees that the access and use of the Services is performed in accordance with his sole discretion and at his own risk and that he will be solely responsible for any damages caused to his computer system or his mobile device or loss of data resulting from the use of the Services or downloading of materials or data contained in the Application, the Site or the links.
Under no circumstances will Movilest, its employees, contractors, directors or agents be liable for any damages, whether direct or indirect, arising out of the use or improper use of the Services, including but not limited to the use of the Contents available through The Application or the Site.
The User agrees to remove Movilest, its affiliated companies, suppliers, contractors and associates harmless from any claims, processes, actions, and any other liabilities (including legal fees) arising out of its use or Abuse of the Services, violation of these Terms and Conditions, violation of the rights of any other person or entity, or any violation of the statements, warranties and agreements made here by the User; As well as compensate them for damages and damages that correspond.

This document constitutes the entire agreement between the User and Movilest related to the matters contained therein. Movilest reserves the right, in its sole discretion, to add, amend or otherwise modify this document without prior notice, by posting it on the Application or on the Site. Therefore, it is advisable that the user re-read this document regularly, so that he is always kept informed of possible modifications.
If there is any modification to this document and the user will continue to use the Services, it will be understood that the User has read and accepted the new Terms and Conditions.
Cookies
The User who uses the Services, agrees to receive Cookies transmitted by Movilest servers.
Final Provisions
The User agrees that in addition to these Terms and Conditions, the use of the Application is subject to the applicable terms and conditions for the platform or servers of the Mobile User Device (App Store, Google Play, etc.).
For all matters related to the compliance and interpretation of these Terms and Conditions, the parties are subject to the applicable legislation, as well as to the jurisdiction of the competent courts of Mexico City, Federal District, hereby waiving any thing by reason of their present or future domicile could correspond to them.
No User may assign or transfer to any third party his rights and obligations hereunder, without the prior written permission of Movilest. Movilest may freely assign its rights and obligations to any third party.
The User may, at any time, cancel his registration on the Site by simple communication in writing addressed to the area of attention to customers of Movilest, without prejudice to the obligations assumed until the date of its exclusion.
The User hereby acknowledges that he has carefully read and understands the content and scope of each and every one of the provisions contained in the Terms and Conditions and the Notice of Privacy.
